The website www.moleskine.com features a series of contents in the form of text, images and film clips owned by the company, third parties or provided by the self-same users of the website, which are protected by the currently applicable copyright regulations.
The following brief notes aim to provide the users and visitors of the site with an equally concise and clear description of the limits within which Moleskine allows the circulation and use of said contents, regardless of who is the owner of the respective rights.
"MOLESKINE WORLD" AREA
I. The history of the Moleskine notebook
The texts used in this section, which provides a description of the "legendary notebook", have been prepared by Moleskine s.r.l., which is the owner of the relative rights to authorship and economic exploitation. They may be freely reproduced for purposes associated with the description of the tradition and the products of Moleskine, also by third parties; the only obligation in this regard is that of mentioning www.moleskine.com as the original source. Every use for commercial purposes or uses that give rise to an economic exploitation of such contents must be understood to be prohibited.
II. Sightings
As to the use of the texts, the same rules as provided above shall apply, while the images and film clips that are published may be subject to particular restrictions provided by the owners of the relative rights. In such cases their publication shall be accompanied by an indication of the source, which the user must consult in order to determine the extent of use which the user, in his or her turn, is allowed.
A user who intends to provide information on a sighting, and who for this purpose provides images or film clips of any kind, assumes the role of guarantor of the fact that such contents may be freely used by Moleskine s.r.l., at least for informative, and not commercial, purposes.
III. Special Projects

"MOLESKINE CITY" AREA
Unless otherwise specified the published texts and images are the property of Moleskine s.r.l. which allows the users of the website to use them freely, with the exception of commercial exploitation, and conditionally upon the obligation to quote www.moleskine.com as source.
Some of the contents of this area are the property of third parties, which make them available by subjecting them to the limits provided by the different regulations of Creative Commons; www.moleskine.com merely refers to the sites of said parties; the user is invited and obliged to comply with the regulations applicable to said sites.
"MYMOLESKINE" AREA
I. Register
The section makes it possible to become a registered user, in order to gain access to the services available to members of the Moleskine community. During the registration procedure the user will be asked to confirm that he or she has examined the information provided in accordance with the Data Protection Code and that he or she agrees with the handling of personal data for the purposes which are described.
II. MSK
Moleskine places at the disposal of its users a number of useful tools, which they may use freely and with no limitations for the purpose of customising their notebooks. Although copies of the contents inserted by the user are temporarily stored for technical reasons, Moleskine guarantees that the data provided and processed by the user through the use of said tools shall in no way be handled by the former, not even on a temporary basis, and that the image files will be deleted at most within 10 days from their creation.
III. My Moleskine Artwork
The person (referred to below as "the Author") who uploads images of Moleskine notebooks made by him/herself to the website thereby declares and warrants to Moleskine S.r.l. that each still and/or moving photographic image portraying the notebook uploaded to the website ("the Upload") is of his/her own preparing and creating, and that it does not, accordingly, constitute plagiarism of any other person's work, even in part. In particular, the Author warrants that the Upload does not constitute infringement by plagiarism or passing-off of any other person's rights in the still and/or moving photographic images themselves nor in the subjects thereof.
The Author likewise declares and warrants that neither the Upload nor any material reproduced therein infringes the intellectual property rights of any other person, including image and personality rights, in that he/she has where necessary received full and unrestricted permission from the holder of such rights, if any. The Author accordingly undertakes to indemnify Moleskine S.r.l. in full for any adverse consequence whatsoever or any claim whatsoever by any other person which may arise out of any deficiency or inaccuracy in the above warranty and declaration by the Author.
By making the Upload to the website, the Author as owner of the copyright in the Upload transfers to Moleskine S.r.l., entirely free of charge and without limit as to territory or time, the exercise of all rights of gainful exploitation arising from the copyright in the Upload, including, but not limited to, the rights to publish the Upload in any manner and form whatsoever, to reproduce, make, distribute, or broadcast the same by any means and in or on any medium whatsoever, to portray the Upload in public, to make the Upload available to the public in any form or manner whatsoever, to display or exhibit the Upload, and to use the Upload in the context of advertising campaigns or promotions, and all adaptation and translation rights in the Upload.
This transfer is governed by the Italian Copyright Act (Law No. 633/1941).
"CATALOGUES" AREA
The texts and images used in this Area and in its sections are the property of Moleskine s.r.l.
They may be freely reproduced for private, informative and descriptive purposes in relation to the Moleskine products, also by third parties, the only obligation being that of quoting www.moleskine.com as original source.
